In addition to a definition and delimitation of the legal institution, a legal framework of automation under constitutional, procedural and EU law is elaborated and specific implementation requirements are formulated. Helmut Birner studierte Rechtswissenschaften mit wirtschaftswissenschaftlicher Zusatzausbildung an der Universität Bayreuth sowie International Commercial Law an der University of Birmingham (LL.M.). Er war Stipendiat der Studienstiftung des deutschen Volkes sowie des Max Weber-Programms Bayern. Im Anschluss war er als wissenschaftlicher Mitarbeiter am Lehrstuhl für Öffentliches Recht und Wirtschaftsrecht bei Prof. Dr. Markus Möstl sowie als Geschäftsführer der Forschungsstelle für Wirtschafts- und Medienrecht tätig. Seine Dissertation wurde im Herbst 2022 angenommen. Nach Abschluss des Referendariats im Bezirk des OLG Bamberg ist er seit Oktober 2024 als Notarassessor im Freistaat Bayern tätig.
