This offers the possibility of a clear differentiation between part performance and the right of retention. The impossibility of freedom of defects leads to an anticipation of rights of buyers in the case of defects. Like the right of retention, the defence of defective goods turns out as an independent legal concept. A differentiated solution depending on the rights in the case of defects is inevitable.
