Der Schutz von Rechtsgütersicherheit als Leitgedanke bei der Auflösung von Lebensnotstandskonstellationen

'The Protection of the Security of Legal Interests as a Guiding Idea of Necessity in Life-Threatening Situations': The refusal to justify the saving of human lives at the cost of human life is self-contradictory, whenever it is accompanied by the endorsement of such acts. A convincing justification of such acts requires an analysis of the reason for the privileged status of omission opposed to active intervention in constellations of necessity. This reason is the positive effect that the protection of the security of legal interests has on the wellbeing of those who are subject to the law.

Marius Kottmann studierte Rechtswissenschaft mit Schwerpunkt im Strafrecht an der Heinrich-Heine-Universität Düsseldorf (HHU). Nach Abschluss des ersten Staatsexamens im Jahr 2017 arbeitete er als Wissenschaftlicher Mitarbeiter und Doktorand am Lehrstuhl für Strafrecht und Strafprozessrecht von Prof. Dr. Helmut Frister in Düsseldorf. Im August 2022 nahm er den juristischen Vorbereitungsdienst im Bezirk des OLG Düsseldorf auf, mit Stationen beim Landgericht Wuppertal, der Staatsanwaltschaft Wuppertal, der NRW.BANK sowie in den Kanzleien Freshfields Bruckhaus Deringer und PARK Wirtschaftsstrafrecht.
