It comes to the conclusion that the claim is a pure instrument of legal realization and that it must be separated from the respective substantive right, which assignes value. Stephan Janich studierte Rechtswissenschaften an der Ruprecht-Karls-Universität Heidelberg und provomierte im Anschluss an der Ludwig-Maximilians-Universität München bei Prof. Dr. Stephan Lorenz. Er war in München bei einer internationalen Wirtschaftskanzlei tätig und absolvierte im dortigen Oberlandesgerichtsbezirk sein Rechtsreferendariat mit Station unter anderem beim Bundespatentgericht. Im Jahr 2021 legte er in Bayern die Zweite Juristische Staatsprüfung ab und ist seit 2022 als Richter in der nordrhein-westfälischen Justiz tätig.
