»The Debt Brake of the Basic Law and its Implementation in the >Länder<. A Contribution to Federal Public Debt Law after the Federalism Reform II«: For the first time in German constitutional history, the German Debt Brake (Art. 109 para. 3 Basic Law) addresses concrete requirements for limiting new public debt on state level to the Länder. In order to make use of the legally permissible credit exceptions - the cyclical component and the emergency clause - the Länder must implement the Debt Brake in their state law. The thesis elaborates the constitutional requirements in the field of public debt law directed at the Länder, measures the legislative and executive design leeway and analyses some of the debt brakes implement by the >Länder<.

Johannes Falter studierte Rechtswissenschaften an der Universität Passau. Nach seiner Ersten Juristischen Prüfung arbeitete er mehrere Jahre promotionsbegleitend als Wissenschaftlicher Mitarbeiter am Lehrstuhl von Herrn Prof. Dr. Hermann Pünder an der Bucerius Law School in Hamburg. Anschließend absolvierte er sein Referendariat im Bezirk des Oberlandesgericht München, unter anderem mit einer Station am Bundesverfassungsgericht. Seit 2017 ist Johannes Falter als Rechtsanwalt mit Schwerpunkten Prozessführung und Gesellschaftsrecht in München tätig.
